- Yourpostcardsite.com provides its registered users (hereinafter: Users) with a service to operate their own e-postcard sites and personal webpage (blog), and the visitors to these sites to send and receive e-postcards
1.) Use and registration
The pages of yourpostcardsite.com are browseable for free to anyone with a regular internet access, while creating a custom postcard / blog site is only available to registered users. Registration is free and open to legal entities and to any person above 18 years of age who can form legally binding contracts under applicable law.
It is the responsibility of the user to keep his/her password in a safe place where nobody else can have access to it. When registering, the user must accept the Terms and Conditions of yourpostcardsite.com. Yourpostcardsite.com reserves the right to cancel Your registration without notice if you have breached this agreement. Your registration will immediately be cancelled in case you
- provide fake or inaccurate personal data at registration
- upload images the use of which are forbidden by applicable law or which breach intellectual or copyright property rights
- use the system to send unsolicited messages, postcards or e-mails (in general, SPAM)
- use the site or its services for any activities which undermine the reputation, business or goodwill of the yourpostcardsite.com, of the users of the site or the operator of yourpostcardsite.com
2.) Liability and Disclaimer
It is the responsibility and liability of the User to guarantee that the images and any textual material uploaded to the site should not
- violate any applicable laws or regulations (including, but without limitation, those relating to import and export control, consumer protection, unfair competition, or false advertising)
- infringe the intellectual property rights of any third party (including, but without limitation, any copyright, patent, trademark, service mark, design right (whether registered or unregistered), trade secret or any other analogous rights
- infringe the right to privacy or publicity of any third party
- defame any third party
- be fraudulent or involve the sale of stolen or counterfeit property or contain descriptions of stolen or counterfeit property
- contain obscene or pornographic material
- knowingly contain any virus or other computer programming routines that may damage or interfere with the operation of the Site, or that may damage, interfere with, intercept or expropriate or (other than data provided for publication on the Site) copy data provided by other participants on the Site
- damage the reputation, business or goodwill of yourpostcardsite.com
The user of the site accepts and understands that
- the operatior(s) of the site can freely suspend or modify the operation of yourpostcardsite.com in order to periodically service its services
- continuous operation is not guaranteed
- the speed and error free operation of the service is not guaranteed
- Yourpostcardsite.com and its respective agents and affiliates will not be liable for any lost profits or any incidental, indirect, special or consequential damages of any kind whatsoever relating to, resulting from, arising out of or connected with the site or this agreement, whether in contract or tort (including negligence), even if they have been advised of or should be aware of the possibility of such damages
- Yourpostcardsite.com and its respective agents and affiliates shall have no obligation or liability to indemnify You or any other person with respect to any litigation or proceeding by a third party resulting from, arising out of, relating to, or connected with this Agreement
3.) Data and privacy
- The information you provide to yourpostcardsite.com or otherwise you submit to the Site may be used by yourpostcardsite.com for the administration of its services and to communicate with you.
- Yourpostcardsite.com may use your registration data to send you Newsletters and information but will not use, disclose or sell your personal information to any third party without your written permission.
4.) Other
yourpostcardsite.com reserves the right, at its discretion, to make additions, substitutions and modifications to this User Agreement with thirty (30) days written notice on it's website.
